Restraint is without consent “if it is accompanied … by deception”. Under the statute, the violation is a class A misdemeanor, unless the person restrained is younger than 17, in which case it is a felony. According to reporting, there were children among those criminally transported to Martha’s Vineyard”.

A Republican Representative in the Florida statehouse has put forth legislation that would significantly weaken libel laws, and critics believe this is an attempt to give Ron DeSantis even more power to sue his critics for saying things he doesn’t like. Legal scholars have trashed the bill, pointing out that a state cannot legally have different thresholds than federal legislation, making this bill all the more confusing.

Florida Sen. Jason Brodeur (R-Lake Mary) wants bloggers who write about Gov. Ron DeSantis, Attorney General Ashley Moody, and other members of the Florida executive cabinet or legislature to register with the state or face fines.

Brodeur’s proposal, Senate Bill 1316: Information Dissemination, would require any blogger writing about government officials to register with the Florida Office of Legislative Services or the Commission on Ethics. In the bill, Brodeur wrote that those who write “an article, a story, or a series of stories,” about “the Governor, the Lieutenant Governor, a Cabinet officer, or any member of the Legislature,” and receives or will receive payment for doing so, must register with state offices within five days after the publication of an article that mentions an elected state official.

Per the above article; “The bill defines a blog as “a website or webpage that hosts any blogger and is frequently updated with opinion, commentary, or business content,” but it says the “term does not include the website of a newspaper or other similar publication.” It also doesn’t say weather it applies only to FL or out of state owners So how can “no income” be verified without homes of blog owners being searched for financial records? DeSantis’s office said Friday it was reviewing the bill. “As usual, the governor will consider the merits of a bill in final form if and when it passes the legislature,” said his press secretary, Bryan Griffin.

“Brodeur did not respond to a request for comment late Thursday. He told the website Florida Politics, which first reported on the bill: “Paid bloggers are lobbyists who write instead of talk. They both are professional electioneers. If lobbyists have to register and report, why shouldn’t paid bloggers?” Ron Kuby, a First Amendment lawyer in New York, said the law would not survive a court challenge if it is passed. “It’s hard to imagine a proposal that would be more violative of the First Amendment,” Kuby said. “We don’t register journalists. People who write cannot be forced to register”

PAID BLOGGERS? I’ve never been paid to post an article and I don’t know any bloggers who are paid. Brodeur assuming blogs which are critical of Republicans receives payment shows he’s either a moron or is attempting to intimidate and shut down critics.

Republicans are continuing their attacks on Civil Rights and Freedom of Speech with Florida Bill HB 991 which significantly weakens libel laws. It weaponizes defamation law to the point that it be a death knell for American traditions of free speech and could be used to crush critics of government policy.

HB 991 is officially called the Defamation, False Light, and Unauthorized Publication of Name or Likenesses Bill. But First Amendment activists like me who have read it call it the “Death to Public Discourse Bill.”

Key supporters of HB 991 want you to believe the legislation is about taming the excesses of the “liberal corporate” media by giving the “little guy” a chance to avenge “bad” coverage. But the truth of this bill is all about making it easier for government officials and their rich and powerful allies to use the courts to punish those who criticize them.

And despite the belief by some conservatives that HB 991 would only affect The New York Times, the Miami Herald and CNN if it were to become law, the reality is no information outlet would be spared the depredations of punitive lawsuits under its provisions. Fox, Newsmax, and conservative talk radio stations will all feel the sting of this new law as public figures across the political spectrum look to exact their vengeance against inconvenient news coverage and commentary. The fallout would just as likely crush Fox’s Tucker Carlson as it would the NYT’s Paul Krugman.

More than that, this legislation would also subject bloggers, community groups, average users of social media — in short everybody who wants their voices heard — to the untold financial and emotional burdens of lawsuits.

Per the above article: The AP reports DeSantis is seeking to undercut a 1964 U.S. Supreme Court decision that shielded news outlets from libel judgments unless proven that they were published with “actual malice” — knowing that something was false or acting with “reckless disregard” to whether it was true. Florida legislation to carry out DeSantis’ plan would make it unnecessary to prove “actual malice” when the allegedly defamatory statements don’t relate to the reason why someone is a public figure.

Goldman says HB 991 would make it easier for the “little guy” to go after media companies reporting false information, but it would also make it easier for the little guy to be sued, as well.

10 Tampa Bay asked Goldman about the implications of this bill. “This law is almost clearly unconstitutional on multiple fronts. And so most legislatures are reluctant to pass unconstitutional laws because they’re just wasting their taxpayers’ time and money,” Goldman said. “But I don’t know that the Florida Legislature is worried about that.”

Andrade noted that publishing true statements is an “absolute defense” against a defamation claim. Divorce, abortion and homosexuality are suppressed and the state is represented as the ultimate guardian of the family institution.

5. Controlled Mass Media – Sometimes to media is directly controlled by the government, but in other cases, the media is indirectly controlled by government regulation, or sympathetic media spokespeople and executives. Censorship, especially in war time, is very common.

6. Obsession with National Security – Fear is used as a motivational tool by the government over the masses.

7. Religion and Government are Intertwined – Governments in fascist nations tend to use the most common religion in the nation as a tool to manipulate public opinion. Religious rhetoric and terminology is common from government leaders, even when the major tenets of the religion are diametrically opposed to the government’s policies or actions.

8. Corporate Power is Protected – The industrial and business aristocracy of a fascist nation often are the ones who put the government leaders into power, creating a mutually beneficial business/government relationship and power elite.

9. Labor Power is Suppressed – Because the organizing power of labor is the only real threat to a fascist government, labor unions are either eliminated entirely, or are severely suppressed.

10. Disdain for Intellectuals and the Arts – Fascist nations tend to promote and tolerate open hostility to higher education, and academia. It is not uncommon for professors and other academics to be censored or even arrested. Free expression in the arts and letters is openly attacked.

11. Obsession with Crime and Punishment – Under fascist regimes, the police are given almost limitless power to enforce laws. The people are often willing to overlook police abuses and even forego civil liberties in the name of patriotism. There is often a national police force with virtually unlimited power in fascist nations.

12. Rampant Cronyism and Corruption – Fascist regimes almost always are governed by groups of friends and associates who appoint each other to government positions and use governmental power and authority to protect their friends from accountability. It is not uncommon in fascist regimes for national resources and even treasures to be appropriated or even outright stolen by government leaders.

13. Manipulate & Control elections – Sometimes elections in fascist nations are a complete sham. Other times elections are manipulated by smear campaigns against or even assassination of opposition candidates, use of legislation to control voting numbers or political district boundaries, and manipulation of the media. Fascist nations also typically use their judiciaries to manipulate & control elections.

14. Powerful and Continuing Nationalism – Fascist regimes tend to make constant use of patriotic mottos, slogans, symbols, songs, and other paraphernalia. Flags are seen everywhere, as are flag symbols on clothing and in public displays.
