According to a new poll released this week, a huge majority of Americans do NOT believe that Donald Trump should be given immunity from his criminal prosecutions, and that even includes a plurality of Republicans. To put that information another way – a majority of Americans believe that Donald Trump should be prosecuted and that the legal system should determine what happens from there. This doesn’t mean they all think he’s guilty, this only means they want to allow the justice system to do its job.

Per the above article; As of March 18, 2024  – Three in five Americans say they think the federal trial on Donald Trump’s 2020 election subversion case should take place before the presidential election in November, levels that have held steady since August 2023, according to a new Politico Magazine/Ipsos poll. The poll also finds that a plurality of Americans believes that Trump, if convicted, should face imprisonment over just probation, a financial penalty, or no penalty whatsoever.

The poll also finds that Americans’ opinions on several of the indictments Trump is facing, including the federal 2020 election subversion case, the sensitive document case, the falsifying business records case, and the Georgia 2020 election subversion case, are highly divided by political identity. That said, the poll finds that over half of Americans believe Trump is guilty in at least one of the four indictments tested, levels that also vary widely across party lines.

Most Americans say they are familiar with Trump’s various legal troubles.

• Seven in ten Americans (69%) say they are familiar with the various investigations, indictments, and trials that Trump is facing.
• Roughly two in three Americans say they understand the details in the legal matters facing Donald Trump, including the federal 2020 election subversion case (64%), the sensitive document case (64%), the falsifying business records case (61%), and the Georgia 2020 election subversion case (61%).
• Most Americans say they don’t think presidents should be immune from criminal prosecution for alleged crimes that took place while they were in office.
• A majority of Americans (70%) say they don’t believe U.S. presidents should be immune from criminal prosecution for alleged crimes that occurred while in office. These levels are higher among Democrats (92%) and independents (75%) compared to Republicans (48%).

It’s worth noting that the explanations by both Reynolds and Pillen are fundamentally incoherent. What does Reynolds even mean by calling the program “not sustainable”? As for Pillen’s crack about “welfare,” he didn’t bother to explain what he believes is wrong with “welfare” as such; he just uttered the term knowing that it’s a dog whistle for conservative voters aimed at dehumanizing the program’s beneficiaries.

What makes these governors’ refusals so much more irresponsible is that the federal government is picking up 100% of the tab for the benefits; the states only have to agree to pay half the administrative costs. Their shares come to $2.2 million in Iowa and $300,000 in Nebraska, according to those states’ estimates.

In return, 240,000 children in Iowa would receive a total of $28.8 million in benefits over the three summer months, and 150,000 Nebraskans would receive a total of $18 million. Sounds like a massively profitable investment in child health in those states”.

So to win elections, the GOP must necessarily reach beyond its own wealthy core and attempt to convince a large segment of working people in the 99% to vote for Republicans.

Trump hired Manafort to run his campaign

After the election, the Trump transition team asked Russia not to retaliate against new US sanctions imposed by then-President Barack Obama. He said: “If you get along and if Russia is really helping us, why would anybody have sanctions if somebody’s doing some really great things?” Putin has tried for years to persuade the US and European countries to end crippling sanctions on Russia’s economy.

Trump refused to say Putin is a killer
Bucking other US leaders, Trump has dismissed credible allegations that Putin uses violence against his opponents. Trump said in 2015, “I think it would be despicable if that took place, but I haven’t seen any evidence that he killed anybody, in terms of reporters.” Asked again in February 2017, Trump deflected, saying, “There are a lot of killers. Do you think our country is so innocent?”

Trump mulled giving spy compounds to Russia
The Washington Post reported in May 2017 that the Trump administration considered returning two diplomatic compounds to Russia. The Obama administration expelled Russian diplomats and seized the compounds in New York and Maryland after the 2016 election, claiming they were used for “intelligence” purposes. The compounds were never returned to Russia.

Trump gave Russia classified intelligence
In a shocking move during the early months of his presidency, Trump shared highly classified intelligence with two senior Russian officials during an Oval Office meeting in May 2017. The intelligence, which was about ISIS, was sensitive enough that it could have exposed a vulnerable source. The unplanned disclosure by Trump rattled even many of his Republican allies.

Trump was reluctant to sign Russian sanctions
Lawmakers passed a bipartisan bill in July 2017 imposing new sanctions against Russia, even though Trump administration officials reportedly tried to water down the language. Trump reluctantly signed the bill, but said the new law contained “clearly unconstitutional provisions.” Trump had little choice in the matter because the bill had passed with veto-proof majorities. (The Treasury Department followed up with several rounds of hard-hitting sanctions.)

Trump thanked Putin for expelling US diplomats
Trump thanked Putin for expelling hundreds of US diplomats from Russia in August 2017, saying, “I want to thank him because we’re trying to cut down our payroll.” Putin kicked out the officials to retaliate for US sanctions. Trump’s view conflicted with the State Department, which said the mass expulsion was “uncalled for.” (Trump later said he was being sarcastic.)

Trump criticized and alienated NATO allies
Trump has repeatedly attacked NATO, aligning himself with Putin, who wants to weaken the alliance. Trump said NATO was “obsolete,” rattling European leaders. At his first NATO summit, Trump scolded other countries for not spending enough on defense and declined to commit to NATO’s mutual defense pledge. (Trump later said he supported the mutual defense provision.)

Trump eased sanctions on Deripaska
In January 2019, the Trump administration lifted sanctions on three Russian companies tied to Oleg Deripaska, a Russian oligarch with close ties to Putin. The Treasury Department had sanctioned Deripaska and the companies over his support for Russian interference in the 2016 election. In a bipartisan rebuke, 11 Senate Republicans supported a Democratic resolution calling for the sanctions to remain.

Ignoring the advice of several top national security aides, Trump congratulated Putin on his March 2018 reelection victory. Putin got 77% of the vote, but Western observers declared that the election “lacked genuine competition” and took place in an “overly controlled legal and political environment.” Trump’s critics said he had given the election legitimacy it did not deserve.

Trump defended USSR invasion of Afghanistan
During a January 2019 Cabinet meeting, Trump defended the Soviet Union’s invasion of Afghanistan. He said the Soviet Union “was right” to invade in 1979 because “terrorists were going into Russia.” The comments puzzled many observers, who noted that the Soviets invaded to bolster a communist government and the US had backed Afghan militants who fought the Soviets.

“Section 3 of the 14th Amendment was written after the Civil War to bar from government any traitors who would seek to destroy the Union. My letter to House leadership today demands that 126 Republicans (and counting) are violating the Constitution”.

The text of the 14th Amendment expressly forbids Members of Congress from engaging in rebellion against the United States. Trying to overturn a democratic election and install a dictator seems like a pretty clear example of that.

On January 20, 2009, the day of President Obama’s Inauguration,  Republican Leaders in Congress plotted to obstruct everything President Obama proposed to make his presidency a failure (in what have become known as the “Caucus Room Conspiracy“), so he and Democrats would be blamed, so Republicans could re-take Congress and the White House in 2012, with no regard to the damage it would cause to the American people.

In Robert Draper’s book, “Do Not Ask What Good We Do: Inside the U.S. House of Representatives” Draper wrote that during a four hour, “invitation only” meeting with GOP Hate-Propaganda Minister, Frank Luntz, the below listed Senior GOP Law Writers literally plotted to sabotage, undermine and destroy America’s Economy by among other things “Just Say No” to everything President Obama proposed.

During the four hour meeting: The senior GOP members plotted to bring Congress to a standstill regardless how much it would hurt the American Economy by pledging to obstruct and block President Obama on all legislation.

These Republican members of Congress were not simply airing their complaints regarding the other party’s political platform for four long hours. These Republican Congressional Policymakers, who were elected to do ‘the People’s work’ were literally plotting to sabotage, undermine and destroy the U.S. Economy.

Agreeing to “Just Say No” to everything President Obama proposed, requires a promise and future action and makes mental reservation of future action and that is in direct violation of the Oath of office.

Every Republican congressman who agreed to “Just Say No” to everything President Obama proposed violated his or her Oath Of Office.   Such an agreement exhibits willful, treasonous  disregard for the American people and the best interests of the Citizens of the United States of America.

These same Republican members of Congress supported the very Bush/Cheney policies that caused America to teeter on the brink of the 2nd Great Depression and caused the 2007 US Economic Meltdown.

Grover Norquist Tax Pledge is also a Oath of Office Violation
A large number of Republicans has signed what’s known as the Grover Norquist Tax Pledge which is a written promise to never increase taxes.

Before taking office, each member of Congress swears a oath to “faithfully discharge the duties of the office.”

The oath taken by both houses of Congress reads:

“I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God”

US Supreme Court Ruling Interprets “Grover Norquist Tax Pledge”, GOP Elected Officials Violating Oath Of Office, “Sincerity Clause” The US Supreme Court precedent holds Grover Norquist GOP Tax Pledge in clear violation of the Oath of Office. The majority of Republicans in Congress has made the “Norquist Tax Pledge” perpetually since 1986 violating their Oath of Office according to the US Supreme Court.

“The Oath of Office does not require a promise of future action, it demands that elected representatives swear that he holds a certain belief at that very moment, loyalty to the Constitution ‘without any mental reservation or purpose of evasion as well as to faithfully discharge the duties of the office they have entered” 401 U.S. 154 S. Ct.(1971) LAW STUDENTS CIVIL RIGHTS RESEARCH COUNCIL, INC., ET AL. v. WADMOND ET AL.

The Norquist Tax Pledge requires a promise and future action and makes mental reservation of future action and inaction in direct violation of the Oath of office itself.

The Constitution of the United States Article I, Section 8: The Congress shall have the Power to lay and collect Taxes…..

The preemptive and unconditional pledge to Norquist by each signer is a knowing and willful repudiation of Article 1, Section 8, of the Constitution and the Sixteenth Amendment. The pledge to Norquist makes signers’ oath of office to uphold the Constitution a fraud on the Congress and the American people. It is also a probable violation of federal criminal law.

Violating Oath of Office is a Federal Crime

Federal law regulating oath of office by government officials is divided into four parts along with an executive order which further defines the law for purposes of enforcement. 5 U.S.C. 3331, provides the text of the actual oath of office members of Congress are required to take before assuming office. 5 U.S.C. 3333 requires members of Congress sign an affidavit that they have taken the oath of office required by 5 U.S.C. 3331 and have not or will not violate that oath of office during their tenure of office as defined by the third part of the law, 5 U.S.C. 7311 which explicitly makes it a federal criminal offense (and a violation of oath of office) for anyone employed in the United States Government (including members of Congress) to “advocate the overthrow of our constitutional form of government”. The fourth federal law, 18 U.S.C. 1918 provides penalties for violation of oath office described in 5 U.S.C. 7311 which include: (1) removal from office and; (2) confinement or a fine.

It would seem there are grounds to remove Republicans who signed the Grover Norquist Tax Pledge which the Supreme Court deemed a violation of the Oath of office. Republicans allegiance should be to the United States of America and the American people, not Grover Norquist.

Republican who agreed to “Just Say No” to everything President Obama proposed should also be removed from office.

It is clear that a large number of Republicans has violated their Oath of Office and made agreements of promises and future action and mental reservation of future action and inaction which violated their of their Oath of Office.

Each and every Republican who engaged in actions which violated their Oath of Office should be held accountable, removed from office and prosecuted.   These Republicans are not just failing to perform their jobs, they’re doing the opposite of what they swore to do.
